Wasteful didactic analysis
Is a didactic analysis by Colin Rubenstein of the much – abused Geneva
Convention / International Law derivations really worthwhile? Letters 31/1 Bishop right on
Israel.
Israel’s avowed enemies have never had the remotest
intention of living peacefully with the Middle East’s only democracy.
It is demonstrable from the earliest days of the terror based creation of the so – called Palestinian people in the 1960’s.
‘’It is widely accepted, even by the Arab League, that there will be land swaps as part of any peace deal, and this can resolve the settlement issue’’
Really? Does anyone believe that any of the Islamic factions in Gaza, Ramallah or elsewhere – either Hamas / Hezbullah or even the Palestinians will remove the obliteration of Israel from their constitutions? Or merely accept that Israel be allowed to be in peace?
Furthermore, prolix analysis including ‘’land swaps’’ and ‘’...genuine bilateral negotiations focusing on all contentious issues...’’ are a utopian ideal that essentially no Palestinian supports. It would surely cost them their lives.
In your dreams: remember 1948, 1967, 1973, multiple Intifadas, and more.
Where is any indicator that there is the remotest yearning for peace negotiations?
Indeed Rubenstein’s over – generous, over – legalistic letter will manifestly be used by enemies of peace to nit – pick his words. That is the way of media manipulation which Colin will probably elicit via his over – generous letter.
Plainly International Law and all derivations of the Geneva Convention is currently used by those who thereby vouchsafe mass – murder on terrorist scale.
It has always been so.

The Palestinian
National Charter,
as amended by the PLO's Palestine
National Council in July 1968, defined "Palestinians" as
"those Arab nationals who, until 1947, normally resided in Palestine regardless
of whether they were evicted from it or stayed there. Anyone born, after that
date, of a Palestinian father – whether in Palestine or outside it – is also a
Palestinian."[55] Note that "Arab nationals" is not religious-specific, and it implicitly includes not only the Arabic-speaking
Muslims of Palestine, but also the Arabic-speaking
Christians of Palestine and other religious communities
of Palestine who were at that time Arabic-speakers, such as the Samaritans and Druze.
Thus, the Jews of Palestine were/are also included, although limited
only to "the [Arabic-speaking] Jews who had normally resided in Palestine until
the beginning of the [pre-state] Zionist invasion." The Charter also states that
"Palestine with the boundaries it had during the British Mandate, is an
indivisible territorial unit."[55][56]

Bishop right on Israel
31/1
COMMENTS by Foreign Minister Julie
Bishop in which she refrained from branding Israel's settlements as illegal have
drawn considerable adverse reaction ("Israeli lawyers caution Bishop", 27/1).
However, Ms Bishop was right, in law and as an expression of Australia's
bipartisan support for a two-state resolution.
Article 49 of the Fourth Geneva
Convention -- the provision usually cited as supposedly making the settlements
illegal -- prohibits a country from transferring its population to land it
occupies. However, it is arguable both that this applies only to forced
transfers or deportations, not voluntary ones, and that, in any case, by the
plain text of the convention itself, it does not apply to the West Bank. This is
because it applies only to land taken from another signatory country that had
the legal right to it. Jordan's occupation of the West Bank prior to 1967 was
illegal.
So when Ms Bishop says "I would like to
see what international law has declared them illegal", she is on solid ground,
backed by numerous eminent international law
authorities.
But even more important than the legal
argument is her policy one: "I don't think it's helpful to prejudge the
settlement issue if you're trying to get a negotiated
solution."
It is widely accepted, even by the Arab
League, that there will be land swaps as part of any peace deal, and this can
resolve the settlement issue.
However, peace will arrive only through
genuine bilateral negotiations focusing on all contentious issues but also
depends on the Palestinians genuinely tackling issues such as continued
incitement to hatred and violence and the refusal to recognise Israel as a
Jewish state.
